Under 46 CFR Part 16 and 49 CFR Part 40, the U.S. Coast Guard mandates drug and alcohol testing for all safety-sensitive maritime personnel. This includes:
Licensed mariners and deck officers
Unlicensed crew members performing operational duties
Tug and towboat operators
Ship maintenance and repair crews
Maritime contractors with access to vessels or docks
Any individual performing safety-sensitive functions aboard a commercial vessel

Maritime employers must implement a DOT-compliant testing program that includes:
Pre-Employment Testing – Must be completed with a negative result before performing safety-sensitive duties
Random Testing – Must be conducted quarterly using a scientifically valid random selection process
Post-Accident Testing – Must be performed when specific criteria are met after a marine incident
Reasonable Cause Testing – For observed signs of drug or alcohol use

Employers are also responsible for:

Any individual performing safety-sensitive duties on a commercial vessel — including licensed mariners, tugboat operators, unlicensed crew, and maritime contractors — must be enrolled in a DOT-compliant drug and alcohol testing program as outlined in 46 CFR Part 16.
Random testing is conducted quarterly throughout the calendar year. Participants are selected using a scientifically valid method and must report for testing immediately upon notification.
Refusals and positive test results are considered violations. The individual must be removed from safety-sensitive dutiesand complete a Return-to-Duty process with a Substance Abuse Professional (SAP) before resuming work.
